When Can You Stop Paying Child Support In Pennsylvania?

In Pennsylvania, all parents are required to financially support their children, even if the relationship between the parents breaks down. In the event that two parents separate or divorce, one parent is typically ordered to pay child support. Over the years, the parent paying support may wonder when they can stop making payments, particularly if support is placing a financial burden on them. When Does Child Support Stop in Pennsylvania? 

In most cases, parents can stop paying child support when the child turns 18 years old or they graduate high school, whichever is later. For example, if a child turns 18 years old while they are still in their senior year of high school, the parent must continue paying support until the child graduates. Likewise, if a child graduates before their birthday, parents must continue paying support until the child turns 18 years old.

Emancipation 

Children under the age of 18 in Pennsylvania can become emancipated. This means that they obtain all the same rights as an adult and that their parents no longer have authority over them. In Pennsylvania, there is no clear procedure or laws regarding emancipation. Judges typically rely on case law when making decisions in emancipation cases and without a court order, it is very difficult to prove. Even if your child is self-sufficient and already lives on their own, this is not necessarily enough to prove that they have been emancipated.

Military Service 

Generally speaking, a person must be at least 18 years old to enlist in the military. However, when a child has permission from their parents, they can join the military when they are 17 years old. Enlisting in the military is considered emancipation and so, if your child is in the military, it is grounds to terminate child support.

Marriage 

When a child marries, parents are no longer required to pay child support. Under state law in Pennsylvania, people must be at least 18 years old to obtain a marriage license. If a child is still in high school when they turn 18 and they get married, this is also considered a form of emancipation and so, it is grounds to terminate child support.

Extending Child Support 

Just as there are instances when child support can be terminated, payments can also be extended in certain situations. If your child has special needs and cannot support themselves financially, you may be required to pay child support. Child support obligations may also continue past a child’s 18th birthday if this was agreed to during divorce proceedings.
