Uncontested Divorces Bring Three Big Benefits

Divorce_Happy

In Pennsylvania, there is more than one way to get divorced. Uncontested divorces bring many benefits for people who want to end their marriage. During an uncontested divorce, the couple reaches an agreement on their own about the different terms of the divorce, including property division, child support, and more. When couples can reach an agreement on their own, the divorce process is generally much easier and proceeds much more smoothly. Below, our Media divorce lawyer outlines the three biggest benefits that come with an uncontested divorce.

Reduce the Cost

Divorce is expensive and some of the costs, such as the filing fee, are out of your control. However, there are some ways you can reduce the cost of your divorce and choosing one that is uncontested is a great way to do it. In many divorce cases, the costs climb quickly because arguments arise between the couple. The more disputes involved in a divorce, the more expensive the case becomes. Couples who can agree to all terms can reduce the costs they pay to just a fraction of the cost of a litigated divorce.

Expedite the Process

People sometimes mistakenly think a divorce has to take a year or more before the case is finalized. Fortunately, this does not always have to be the case. When divorce cases do drag on for a long period of time, it is usually because there are multiple disputes between the couple that must be resolved. To resolve those disputes, lawyers on both sides have to negotiate or a judge has to make the final decision. Waiting for a court hearing or a fair outcome in negotiations can take time.

Under Pennsylvania law, all couples must wait at least 90 days from the date of filing the divorce petition with the court. Couples who can agree to all terms can finalize their divorce as soon as the waiting period expires, allowing them to move forward with their new life sooner.

Control Over the Process

When couples have to go to court to resolve their disputes, a judge will make all the decisions in the case. Although couples can present arguments in court to help a judge make decisions in the case, neither party has a say if the court issues a decision that is unfavorable to them. Once a judge has decided on all the issues of the case, they will issue court orders that are final and legally binding. Couples who can reach an agreement on their own retain full control over the process with each party having a say in the final agreement.
