When a divorce case goes to trial, they will present their arguments to a judge before the judge makes all final decisions. These decisions are not only final, but they are also legally binding. Family law judges will apply case law and statute formulas when making these decisions. They will not necessarily consider the preferences of either side. By getting an uncontested divorce, you and your spouse can agree on your own about the terms of the divorce.
