Traditionally, this may have been true, as mothers were often the ones to stay home and raise the children. Today, though, this is often no longer the case. Many fathers stay home, or both parents work to support the family. The family courts today only consider what is in the best interests of the child, which is usually joint custody. Judges will consider many factors when making these decisions, but gender is never one of them.

Marital Property is Divided 50/50 

Another common myth is that marital property is divided exactly equally between the couple. Marital property refers to any assets and liabilities acquired by the couple during the marriage. Pennsylvania is an equitable distribution state, which means that marital property is divided fairly, although not necessarily equally, between the couple.

Alimony is Always Awarded 

Alimony, or spousal support, is one of the most contentious issues in any divorce. However, many people think alimony is always awarded, and that is not true. For example, the courts are unlikely to award alimony when a marriage lasts three years or less, unless there are compelling circumstances. Even when alimony is awarded, it is not usually indefinite. Most alimony awards are given for a certain period of time.

Divorce Damages Children 

Many people stay together for the kids, believing it is a noble choice even if the couple is unhappy. This myth too, is extremely outdated. Research over the years has shown that children are incredibly resilient and in fact, living with conflict and stress between parents is more stressful for them than an actual divorce. Children are very capable of adapting to post-divorce life, particularly when they have the proper support and guidance from both parents.

Divorce Carries a Stigma 

It is true that at one time, divorce carried a social stigma and divorcees often faced judgment. Divorce has not had this stigma for many decades. Today, public perception has changed and most people recognize divorce as the personal matter it is. Additionally, with nearly half of marriages ending in divorce today it is much more common and so, it no longer strikes people as an unusual occurrence.
